These Terms of Use ("Terms") govern your access to and use of the Real Car Offer website, tools, and instant offer services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old and legally able to enter into contracts. You must be the titled owner of the vehicle, or have clear, written authority to sell it. You agree to provide accurate, current, and complete information about yourself and your vehicle. You agree not to use the Service for unlawful, fraudulent, or abusive purposes.

Any price, instant offer, or valuation shown on the site is conditional and subject to in-person inspection and verification of your vehicle, title, mileage, options, and condition. Offers are typically valid for 7 days and 500 miles from the time they are generated, unless we clearly state otherwise. Your final purchase price may change if your vehicle's condition, equipment, mileage, title, or history differs from what you provided, or if new information is discovered during the appraisal or inspection process. No offer is final or binding until you sign all required sale documents at a participating dealership or buying center.

We may advertise that we will beat a written offer from a well-known, reputable car-buying company and add $100 on top. Details and eligibility requirements are explained in our Valuation & Offer Terms, which are incorporated into these Terms.

You are responsible for disclosing known issues, prior damage, accident history, and title brands. We may use third-party sources, such as vehicle history providers, to verify mileage, title brands, and reported accidents. These sources may contain errors, and we do not guarantee their completeness. We may decline to purchase vehicles with certain title brands, significant prior damage, missing equipment, or other conditions at our sole discretion.

Information provided on the site, including valuations, comparisons, and FAQs, is for general informational purposes only and does not constitute financial, tax, or legal advice. You should consult your own advisors about any sale, payoff, or tax implications.

All content on the site, including text, graphics, logos, icons, and software, is owned by us or our licensors. You may use the site for personal, non-commercial purposes only. You may not copy, modify, distribute, reverse engineer, or create derivative works from the site or its content without our prior written consent.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT PAID BY US TO YOU FOR YOUR VEHICLE IN THE TRANSACTION GIVING RISE TO THE CLAIM, IF ANY.

You agree to indemnify and hold us, our affiliates, and our respective officers, directors, employees, and agents harmless from and against any claims, losses, damages, liabilities, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your use of the Service; (b) your breach of these Terms; or (c) your violation of any law or the rights of a third party.

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Service will be resolved in the state or federal courts located in California, and you consent to personal jurisdiction and venue in those courts, unless a different process is required by applicable law.

We may update these Terms from time to time. When we do, we will update the Updated date near the top. Your continued use of the Service after changes are posted means you accept the revised Terms.
